It has happened to most of us at one time or another. You are driving along when you see the police car's lights. All it takes is a moment of inattention; the speed creeps up or you fail to see a sign. If it should happen to you, here are a few tips that you should follow.
Getting pulled over
Stay calm, pull over to the nearest safe spot on the right side of the road and stop. Roll down your window, place your hands on the wheel in plain sight and do not do anything else unless directed by the officer.
Until directed by the officer DO NOT:
Reach for your glove box to retrieve your vehicle registration Reach into your pocket or purse for your license Make any other suspicious movementsRemember, to the law enforcement officer, there is no such thing as a routine traffic stop. A driver reaching for a vehicle registration looks the same as a driver reaching for a gun. These actions make the officer very nervous.
Once the officer asks you to produce your license, registration and proof of insurance, let him or her know where you will be reaching and wait for the officer to give you permission.
Treating the officer with respect and holding your temper will make the process go much more smoothly. Drivers who are respectful and don't argue with the officer may sometimes find themselves receiving a ticket for a less serious offense. Be patient; once the officer has reviewed your license and registration, he or she will explain what you did wrong. Arguing with the officer will do you no good; that's what the courts are for.
Once the officer has written out the ticket, you will be asked to sign it and you will be given a copy. Signing a ticket doesn't mean you are admitting guilt, it only means you are acknowledging that you have been informed of the court date listed on the ticket.
Infraction or misdemeanor?
Infractions are common violations, like speeding, or making an illegal turn. Drivers have the option of paying the fine or going to court to contest the charge.
Misdemeanors however, are for more serious offenses, like DUI or reckless driving. Tickets issued for a misdemeanor means the offender must appear in court.
Pay the fine, go to traffic school...
Most drivers have the option of admitting guilt and just paying the fine or requesting traffic school to have the case dismissed. Drivers charged with a misdemeanor will not be able to attend CA traffic school.
Motorists in California can pay their fines by mail, online, or personally. All the contact information is on the ticket. If there are any more questions, contact the California clerk of court in the county where the ticket was issued.
...or appear in court to contest the ticket.
A driver who wants to contest the ticket, or who has been charged with a misdemeanor, must appear in court. Those drivers should contact the traffic court in the issuing county at least a week before the court date to finalize details of their trial. The court will send forms for you to fill out listing the reasons you are contesting the case.
During the preliminary hearing, a motorist is asked to enter his/her plea. They will also be required to post bail (usually the amount of the fine plus court costs). Contact the court to verify the amount before your court date.
